About our privacy policy

Smartsporter cares deeply about your privacy. Therefore, we only process data that we need for (improving) our services and handle the information collected about you and your use of our services with great care. We never provide your data for commercial purposes to third parties.

This privacy policy applies to the use of the website and the related services of Smartsporter. The effective date for these terms is 20/02/2024, and with the publication of a new version, the validity of all previous versions expires. This privacy policy describes what data about you is collected by us, how this data is used, and under what conditions this data may be shared with third parties. We also explain how we store your data, how we protect it from misuse, and what rights you have regarding the personal data you provide to us.

About data processing

Below, you can read how we process your data, where we store it (or have it stored), what security techniques we use, and who has access to the data.

E-commerce software

Shopify
Our webshop is developed using Shopify software. Personal data that you provide to us for the purpose of our services is shared with this party. Shopify has access to your data to provide us with technical support, and they will never use your data for any other purpose. Based on the agreement we have with them, Shopify is obliged to take appropriate security measures. These security measures include the use of SSL encryption and a strong password policy. Shopify is a certified processor of credit card data. Shopify uses cookies to collect technical information regarding your use of the software; no personal data is collected or stored. Shopify reserves the right to share collected data within its own group to further improve its services. Shopify complies with the applicable legal retention periods for (personal) data. The EU/US Privacy Shield applies; your data may be processed in the United States.

Email and mailing lists

Office365
For our regular business email traffic, we use the services of Office365. This party has implemented appropriate technical and organizational measures to prevent abuse, loss, and corruption of your and our data as much as possible. Office365 does not have access to our mailbox, and we treat all our email traffic confidentially.

Payment processors

Klarna
To process (part of) the payments in our webshop, we use the Klarna platform. Klarna processes your name, address, and place of residence data, as well as your payment details such as your bank account or credit card number. Klarna has implemented appropriate technical and organizational measures to protect your personal data. Klarna reserves the right to use your data to further improve its services and, in that context, share (anonymized) data with third parties. In the case of a request for a deferred payment (credit facility), Klarna shares personal data and information regarding your financial position with credit rating agencies. All the safeguards mentioned above regarding the protection of your personal data also apply to the parts of Klarna's services for which they engage third parties. Klarna does not retain your data longer than allowed by legal terms.

WebwinkelKeur
We collect reviews via the WebwinkelKeur platform. If you leave a review via WebwinkelKeur, you are required to provide a name and email address. WebwinkelKeur shares this data with us so that we can link the review to your order. In some cases, WebwinkelKeur may contact you to provide an explanation of your review. In the event that we invite you to leave a review, we share your name and email address with WebwinkelKeur. They use this data solely for the purpose of inviting you to leave a review. WebwinkelKeur has implemented appropriate technical and organizational measures to protect your personal data. WebwinkelKeur reserves the right to engage third parties for the purpose of providing the service; we have given permission to WebwinkelKeur for this. Shipping and logistics

DHL
When you place an order with us, it is our responsibility to have your package delivered to you. We use the services of DHL for the execution of deliveries. It is necessary for us to share your name, address, and place of residence data with DHL. DHL uses this data solely for the purpose of executing the agreement. In the event that DHL engages subcontractors, DHL also provides your data to these parties.

Purpose of data processing

General purpose of processing
We use your data solely for the purpose of our services. This means that the purpose of processing is always directly related to the assignment you provide. We do not use your data for (targeted) marketing. If you share data with us and we use this data to contact you at a later time - other than at your request - we will explicitly ask for your consent. Your data is not shared with third parties, except to meet accounting and other administrative obligations. These third parties are all bound to confidentiality based on the agreement between them and us, or an oath or legal obligation.

Automatically collected data
Data that is automatically collected by our website is processed with the aim of further improving our services. This data (such as your IP address, web browser, and operating system) is not personal data.

Cooperation with tax and criminal investigations
In certain cases, Smartsporter may be obliged to share your data on the basis of a legal obligation in connection with fiscal or criminal investigations by government authorities. In such a case, we are forced to share your data, but we will resist to the extent possible within the limits of the law.

Retention Periods
We retain your data as long as you are a client of ours. This means that we keep your customer profile until you indicate that you no longer wish to use our services. If you inform us of this, we will also consider it as a request for forgetting. This also means that we do not keep your data for more than two years from the last contact moment or transaction, unless there is a legal justification for doing so. Due to applicable administrative obligations, we are required to keep invoices with your (personal) data, so we will retain this data for the duration of the relevant term. However, employees no longer have access to your client profile and documents that we have produced based on your order.

Your Rights

Under the applicable Dutch and European legislation, you, as the data subject, have certain rights regarding the personal data processed by or on behalf of us. We explain these rights below and how you can invoke them. In principle, to prevent misuse, we only send copies of your data to your already known email address. In case you want to receive the data at a different email address or by post, for example, we will ask you to identify yourself. We keep a record of handled requests, and in the case of a forget request, we record anonymized data. All copies and copies of data are provided in the machine-readable data format that we use within our systems. You can make a request to our privacy contact person with that intention. You will then receive a response to your request within 30 days. If your request is granted, we will send you a confirmation to your known email address that the data has been adjusted.

Right to Restriction of Processing
You always have the right to restrict the data that we (or others on our behalf) process that relate to your person or can be traced back to you. You can make a request to our privacy contact person with that intention. You will then receive a response to your request within 30 days. If your request is granted, we will send you a confirmation to your known email address that the data will no longer be processed until you lift the restriction.

Right to Data Portability
You always have the right to have the data that we (or others on our behalf) process and that relate to your person or can be traced back to you carried out by another party. You can make a request to our privacy contact person with that intention. You will then receive a response to your request within 30 days. If your request is granted, we will send you copies or duplicates of all data about you that we have processed or that has been processed on our behalf by other processors or third parties. In all likelihood, we cannot continue the service in such a case because the secure linking of data files can no longer be guaranteed.

Right of Objection and Other Rights
In certain cases, you have the right to object to the processing of your personal data by or on behalf of smartsporter. If you object, we will immediately stop processing the data pending the handling of your objection. If your objection is well-founded, we will provide you with copies and/or copies of data that we (or others on our behalf) process and then permanently stop processing. You also have the right not to be subject to automated individual decision-making or profiling. We do not process your data in such a way that this right applies. Google Analytics
